Employment Security at Ekurhuleni

17/10: The City of Ekurhuleni has come out as the best metropolis in South Africa after making strides by increasing Employment Security for its residents with 98 000 jobs in 2017.

This is according to the recent Quarterly Labour Force Survey (QLFS), which reveals that Ekurhuleni has beaten the City of Cape Town which managed to increase its job opportunities only by 63 000 and eThekwini with an increase of 58 000 jobs.

The survey also reflected that there were job losses in the City of Johannesburg (30 000) and Mangaung (4 000).

The survey reflected on employment contracts and Employment Security in South Africa for the second quarter of the 2017 calendar year and final quarter of the financial year.

Mayor Mzwandile Masina, who has welcomed the survey on behalf of Ekurhuleni, said the City would continue to create a favourable environment by helping its residents create sustainable jobs with the City’s 10-point plan.

What is Employment Security?

This can take various forms, but essentially refers to contracts and agreements concerning employment and job security. Most frequently, it refers to job contracts, but can also include information on probation periods, fair and unfair dismissal and employee agreements.

Every employer is required by law (the Basic Conditions of Employment Act – section 29) to provide an employee with a written contract of employment not later that the first day of commencement of employment.

This document regulates the terms and conditions of employment between the employer and the employee.

The contract will state what the employee is entitled to receive in terms of company policy, company benefits, and labour legislation, and what the employer will provide in terms of benefits and labour legislation.

It also regulates the behaviour of the employee in the workplace - because all company policies and procedures, as well as the disciplinary code, form a part of the employment contract.

There are various types of employment contracts such as permanent employment, fixed term employment and project employment.

The employment document must be updated when:

  • The law changes.
  • The employee and employer agree to changes in the terms and conditions.
  • The  employee’s pay or benefits increase.

If there is no contract, it is not only illegal but it is extremely difficult to take action if either an employee or an employer has a grievance, or wants to query a situation in the workplace.
